TERMS OF SERVICE

IMPORTANT: THESE TERMS OF SERVICE CONTAIN A MANDATORY BINDING ARBITRATION PROVISION AND A CLASS ACTION WAIVER IN SECTION 15. PLEASE READ SECTION 15 CAREFULLY. 1. ACCEPTANCE OF TERMS

By accessing or using GetMedKits ("we," "us," or "our") services, website (getmedkits.us), or any associated web pages, booking a consultation, submitting an intake form, making a payment, or communicating with us by any means, you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, our Consumer Health Data Privacy Policy, and our Telehealth Consent (collectively, the "Agreements"). If you do not agree to all of these Terms, do not use our services.

These Terms constitute a legally binding agreement between you and GetMedKits. By checking the consent box on our booking page or intake form, you acknowledge that you have read, understood, and agree to be bound by these Terms, including the mandatory arbitration provision and class action waiver in Section 15.

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page and provide notice through our website or by direct communication. Your continued use of our services after any modification constitutes acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using our services. We will not retroactively apply material changes to disputes that arose before the change was posted.

2. ELIGIBILITY

You must be at least 18 years of age and physically located in the United States to use our services. In limited circumstances, a parent or legal guardian may use our services on behalf of a minor patient with appropriate physician authorization and verified parental consent. By using our services, you represent and warrant that you meet these eligibility requirements, that the information you provide is accurate and complete, and that you have the legal capacity to enter into a binding agreement.

3. DESCRIPTION OF SERVICES

GetMedKits is a telehealth coordination platform that provides administrative, scheduling, and coordination services to connect patients with independently licensed healthcare providers. Our services include providing informational consultations via telephone with patient coordinators, facilitating clinical intake and review by independently licensed physicians and nurse practitioners, coordinating prescription fulfillment through licensed U.S. compounding pharmacies, and coordinating medication shipping and delivery.

GetMedKits does NOT practice medicine. GetMedKits does NOT employ physicians for the purpose of practicing medicine. GetMedKits does NOT direct, control, or influence clinical decisions, prescribing outcomes, or the exercise of professional medical judgment by any healthcare provider. All medical decisions, including whether to prescribe, what to prescribe, at what dosage, and for what duration, are made solely by the independently licensed treating physician or nurse practitioner based on their independent clinical judgment.

The initial consultation available through our website is a non-clinical informational call conducted by a patient coordinator, not by a physician or licensed healthcare provider. This call does not constitute medical advice, does not establish a doctor-patient relationship, and is not a substitute for professional medical evaluation. The purpose of this call is to provide general information about our services, answer questions about how the process works, and assist with registration.

4. INDEPENDENT PHYSICIAN RELATIONSHIP

The physicians and nurse practitioners who provide medical services through this platform are independently licensed healthcare providers. They are not employees, agents, or representatives of GetMedKits. Nothing in these Terms or in the operation of our platform creates an employer-employee, partnership, joint venture, or agency relationship between GetMedKits and any healthcare provider.

The physician-patient relationship exists solely between you and your treating provider. GetMedKits is not a party to that relationship. GetMedKits does not supervise, direct, or interfere with clinical decisions. GetMedKits does not set prescribing quotas, require any specific prescribing outcome, or compensate physicians based on the volume or type of prescriptions written.

Healthcare providers are solely responsible for the medical services they provide to you, including compliance with applicable standards of care, informed consent, medical recordkeeping, and all other professional obligations. GetMedKits is not responsible for the acts, omissions, or decisions of any independently licensed healthcare provider.

Your treating physician may determine, in their sole clinical judgment, that the services or medications available through this platform are not appropriate for your condition. The physician has full and exclusive authority to decline to prescribe, to modify dosing, to recommend alternative treatments, or to discontinue treatment at any time and for any reason.

5. OFF-LABEL PRESCRIBING ACKNOWLEDGMENT

BY USING OUR SERVICES, YOU ACKNOWLEDGE AND AGREE TO THE FOLLOWING:

The medications available through this service, including but not limited to ivermectin, mebendazole, and methylene blue, are FDA-approved medications for specific non-oncologic indications. These medications are NOT FDA-approved for the treatment, cure, mitigation, or prevention of cancer or any oncologic condition. When prescribed through this service, these medications may be prescribed for off-label uses.

Off-label prescribing is a legal, common, and well-established medical practice in which a physician prescribes an FDA-approved medication for an indication, dosage, population, or route of administration that has not been specifically approved by the FDA. The FDA recognizes that once a drug is approved, healthcare providers may prescribe it for uses other than those studied and approved when they judge it to be medically appropriate for their individual patient.

No guarantee of efficacy is made or implied. The fact that a medication may be supported by published scientific research does not mean that the FDA has approved it for that use or that it will be effective for your condition. You understand that the scientific evidence supporting off-label uses of these medications varies in quality and quantity, and that your treating physician will discuss the relevant evidence, risks, and benefits with you as part of the clinical process.

You acknowledge that you are choosing to explore these medications voluntarily, that you have had the opportunity to ask questions, and that you understand the off-label nature of the prescriptions that may be written for you. You further acknowledge that these medications are being used as adjunctive support alongside, not as a replacement for, conventional cancer treatments recommended by your oncologist or primary care physician.

6. COMPOUNDED MEDICATION DISCLAIMERS

The medications dispensed through this service are compounded by a licensed U.S. compounding pharmacy operating under Section 503A of the Federal Food, Drug, and Cosmetic Act. Compounded medications are prepared pursuant to a valid patient-specific prescription from a licensed healthcare provider.

COMPOUNDED MEDICATIONS ARE NOT FDA-APPROVED. THE FDA DOES NOT VERIFY THE SAFETY, EFFECTIVENESS, OR QUALITY OF COMPOUNDED MEDICATIONS BEFORE THEY ARE MARKETED OR SOLD. Compounding is a practice in which a pharmacist combines, mixes, or alters ingredients to create a medication tailored to the needs of an individual patient. Compounded medications may carry risks beyond those of commercially manufactured drugs, including but not limited to variability in potency, purity, stability, and sterility.

The compounding pharmacy operates independently from GetMedKits. GetMedKits does not manufacture, compound, package, label, or inspect medications. GetMedKits is not responsible for errors, omissions, contamination, mislabeling, or any other issue arising from the pharmacy's compounding, dispensing, or shipping processes.

You acknowledge that you understand these risks and accept them as part of your decision to use compounded medications prescribed through this service.

7. NO EMERGENCY SERVICES

THIS PLATFORM DOES NOT PROVIDE EMERGENCY MEDICAL SERVICES. IF YOU ARE EXPERIENCING A MEDICAL EMERGENCY, CALL 911 IMMEDIATELY OR GO TO YOUR NEAREST EMERGENCY ROOM.

GetMedKits is not a substitute for emergency care, urgent care, primary care, or ongoing medical treatment. Our services are not designed for acute or time-sensitive medical conditions. Do not delay seeking emergency care based on any information or communication received through this platform.

8. USER OBLIGATIONS

By using our services, you agree to the following obligations:

You will provide truthful, accurate, and complete information about your identity, health history, current medications, supplements, allergies, current treatments (including chemotherapy, radiation, immunotherapy, and all other conventional therapies), and any other information requested during the intake process or by the treating physician.

You will promptly inform your treating physician and GetMedKits of any changes in your health status, medications, or treatments that may affect your care.

You will not provide false, misleading, or incomplete information on any form, during any call, or in any communication with GetMedKits or your treating physician.

You will use medications prescribed through this service for your personal use only. You will not share, sell, distribute, or transfer your prescription medications to any other person.

You will read all medication information, instructions, and warnings provided with your prescription and follow your physician's dosing instructions.

You will not use this platform to obtain medications for any unlawful purpose.

You are responsible for ensuring that the contact information you provide (phone number and email address) is accurate and current, as we use this information to verify your identity when you contact us.

You acknowledge that the treating physician may determine, in their sole discretion, that this service is not appropriate for your condition, and you accept that determination without dispute against GetMedKits.

If you provide false or incomplete health information and an adverse event occurs as a result, you accept sole responsibility for the consequences of your failure to provide accurate information.

9. PAYMENT AND BILLING

All fees are communicated to you verbally during your consultation call before payment is collected. Payment is processed over the phone through our third-party payment processor's invoicing system. Payment is not collected through our website. We do not store full credit card numbers on our systems.

By providing payment, you confirm that you have been informed of the total amount due, you understand the refund policy described in Section 10, you have the legal right to use the payment method provided, and you authorize the charge.

Our services are cash-pay only. We do not accept insurance, Medicare, Medicaid, or any other third-party payor. You agree that you will not submit claims to any insurer or government program for reimbursement of fees paid to GetMedKits.

Pricing may vary based on the specific medications, dosing, and protocol recommended by your treating physician. Fees cover the coordination of your care, including the physician consultation, prescription (if medically appropriate), compounding, and shipping. Individual components are not separately refundable.

GetMedKits is not responsible if your payment is declined by your financial institution.

Our services are provided on a one-time, per-order basis. We do not charge recurring subscription fees, monthly membership fees, or auto-renewal charges. Each purchase is a separate, standalone transaction. We will never charge your payment method again without your express authorization for a new order.

10. REFUND POLICY

You may request a full refund at any time before the physician has reviewed your intake and approved a prescription.

Once the physician has approved your prescription and the compounding pharmacy has begun preparing your medication, no refund will be issued. Compounded medications are prepared specifically for you based on your individual prescription and cannot be restocked, resold, or reused.

In individual circumstances where an issue arises with your order (such as non-delivery, verified shipping damage, or wrong medication compounded), GetMedKits may, at its sole discretion, issue a partial or full refund or replacement on a case-by-case basis. Refunds are not guaranteed in these situations and will be evaluated individually.

If the treating physician determines that you are not a candidate for the prescribed medications and declines to write a prescription, you will receive a full refund of amounts paid for medication and compounding, less any consultation fees that have already been earned.

To request a refund, contact us at [email protected] or +1 (346) 220-0227 within 30 days of your payment date. Requests received after 30 days will not be processed.

Disputing a charge with your credit card company (initiating a chargeback) instead of contacting us first may result in suspension of your access to our services. We encourage you to contact us directly so we can resolve any issue before you contact your financial institution.

11. PRESCRIPTION MEDICATION RETURNS

Federal and state regulations prohibit the return of prescription medications once dispensed. Compounded prescription medications cannot be returned to the pharmacy or to GetMedKits for any reason, including but not limited to change of mind, dissatisfaction with results, decision to discontinue use, or expiration. All sales of compounded prescription medications are final once the medication has been dispensed and shipped by the pharmacy.

This policy exists because prescription medications that have left the pharmacy's control cannot be verified for integrity, safety, or proper storage conditions, and cannot legally be re-dispensed to another patient.

12. INTELLECTUAL PROPERTY

All content on our website, including but not limited to text, graphics, logos, images, design elements, trade names, and the compilation thereof, is the property of GetMedKits or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws. You may not reproduce, republish, distribute, modify, transmit, display, sell, or create derivative works of any content from our website without prior written permission from GetMedKits. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use our website for your personal, non-commercial use only.

13. DISCLAIMER OF WARRANTIES

ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THAT ANY INFORMATION PROVIDED THROUGH OUR SERVICES IS ACCURATE, COMPLETE, RELIABLE, OR CURRENT. WE DO NOT WARRANT THAT ANY MEDICATION PRESCRIBED THROUGH THIS SERVICE WILL BE EFFECTIVE FOR YOUR CONDITION. WE DO NOT WARRANT ANY SPECIFIC HEALTH OUTCOME.

THE FOREGOING DISCLAIMERS DO NOT APPLY TO THE EXTENT PROHIBITED BY APPLICABLE LAW. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM GETMEDKITS OR THROUGH OUR SERVICES SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

14. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, GETMEDKITS AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE OUR SERVICES, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF OUR SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT OF FEES PAID BY YOU TO GETMEDKITS IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

GETMEDKITS IS NOT LIABLE FOR THE ACTS, OMISSIONS, ERRORS, OR DECISIONS OF ANY INDEPENDENTLY LICENSED HEALTHCARE PROVIDER, INCLUDING BUT NOT LIMITED TO PRESCRIBING DECISIONS, MISDIAGNOSIS, FAILURE TO DIAGNOSE, ADVERSE DRUG REACTIONS, DRUG INTERACTIONS, OR FAILURE TO WARN. CLAIMS AGAINST HEALTHCARE PROVIDERS SHOULD BE DIRECTED TO THE PROVIDER AND THEIR PROFESSIONAL LIABILITY INSURER.

GETMEDKITS IS NOT LIABLE FOR THE ACTS, OMISSIONS, OR ERRORS OF ANY COMPOUNDING PHARMACY, INCLUDING BUT NOT LIMITED TO COMPOUNDING ERRORS, CONTAMINATION, MISLABELING, INCORRECT DOSING, POTENCY VARIATIONS, SHIPPING DAMAGE, DELIVERY DELAYS, OR FAILURE TO FOLLOW PRESCRIBED FORMULATIONS.

GETMEDKITS IS NOT LIABLE FOR ANY ADVERSE HEALTH OUTCOME, SIDE EFFECT, DRUG INTERACTION, ALLERGIC REACTION, OR INJURY ARISING FROM THE USE OR MISUSE OF ANY MEDICATION PRESCRIBED THROUGH THIS SERVICE.

NOTHING IN THESE TERMS SHALL LIMIT LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY OUR GROSS NEGLIGENCE OR WILLFUL MISCONDUCT, OR FOR FRAUD OR FRAUDULENT MISREPRESENTATION, OR FOR ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED BY APPLICABLE LAW.

IF THE APPLICABLE LAW DOES NOT ALLOW THE LIMITATION OF LIABILITY AS SET FORTH ABOVE, THE LIMITATION WILL BE DEEMED MODIFIED SOLELY TO THE EXTENT NECESSARY TO COMPLY WITH APPLICABLE LAW.

THIS SECTION SHALL SURVIVE THE TERMINATION OR EXPIRATION OF THESE TERMS.

15. MANDATORY BINDING ARBITRATION AND CLASS ACTION WAIVER

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND HAVE A JURY HEAR YOUR CLAIMS.

A. Agreement to Arbitrate

You and GetMedKits agree that any dispute, claim, or controversy arising out of or relating to these Terms, our services, any medication prescribed or dispensed through our service, any communication between us, or any aspect of your relationship with GetMedKits (collectively, "Disputes"), shall be resolved exclusively through final and binding individual arbitration, rather than in court, except as set forth in subsections below. This arbitration agreement is governed by the Federal Arbitration Act (9 U.S.C. 1-16) and shall be interpreted in accordance with the FAA regardless of any contrary state law.

This agreement to arbitrate is intended to be broadly interpreted and includes, without limitation, claims arising under federal, state, or local statutory or common law, including but not limited to consumer protection claims, tort claims, contract claims, fraud claims, privacy claims, and claims relating to advertising, marketing, or representations made about our services.

B. Arbitration Rules and Forum

Arbitration shall be administered by the American Arbitration Association ("AAA") under the AAA Consumer Arbitration Rules then in effect, available at adr.org. If AAA is unavailable or unable to administer the arbitration, the parties agree to use JAMS under its Streamlined Arbitration Rules and Procedures. If neither AAA nor JAMS is available, a court of competent jurisdiction shall appoint an arbitrator.

Payment of arbitration fees shall be governed by the AAA Consumer Arbitration Rules. Under current AAA rules, the consumer's filing fee is capped at $225 for claims under $75,000. GetMedKits will pay all remaining AAA filing, administration, and arbitrator fees for non-frivolous claims.

C. Arbitration Procedures

The arbitration shall be conducted by a single neutral arbitrator. Any arbitration hearing shall take place in the county of your residence, at another mutually agreed location, or by telephone or video conference at your election. The arbitrator shall have exclusive authority to resolve all Disputes, including the scope, enforceability, and arbitrability of this arbitration agreement, except that a court of competent jurisdiction shall have exclusive authority to determine the enforceability of the class action waiver in subsection E below. The arbitrator shall follow applicable substantive law and may award any individual relief that a court could award, including injunctive and declaratory relief. The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

D. Informal Dispute Resolution Before Arbitration

Before initiating arbitration, you agree to contact us at [email protected] with the subject line "Dispute Notice" to attempt to resolve the dispute informally. The Dispute Notice must include your name, the email address associated with your service, a description of the dispute, and the relief you are seeking. We will attempt to resolve the dispute informally within 60 days of receiving your Dispute Notice. If the dispute is not resolved within 60 days, either party may proceed to arbitration.

E. Class Action Waiver

YOU AND GETMEDKITS AGREE THAT ALL DISPUTES SHALL BE RESOLVED ON AN INDIVIDUAL BASIS ONLY. NEITHER YOU NOR GETMEDKITS SHALL BE ENTITLED TO JOIN, CONSOLIDATE, OR INCLUDE CLAIMS WITH OR AGAINST OTHER INDIVIDUALS OR ENTITIES, OR ARBITRATE OR LITIGATE ANY DISPUTE ON A CLASS-WIDE, REPRESENTATIVE, OR COLLECTIVE BASIS. THERE SHALL BE NO RIGHT OR AUTHORITY FOR ANY DISPUTE TO BE BROUGHT, HEARD, OR ARBITRATED AS A CLASS ACTION, COLLECTIVE ACTION, REPRESENTATIVE ACTION, PRIVATE ATTORNEY GENERAL ACTION, OR IN ANY PROCEEDING IN WHICH YOU OR GETMEDKITS ACTS OR PROPOSES TO ACT IN A REPRESENTATIVE CAPACITY.

THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A REPRESENTATIVE OR CLASS PROCEEDING.

IF THIS CLASS ACTION WAIVER IS FOUND TO BE UNENFORCEABLE AS TO A PARTICULAR CLAIM OR REQUEST FOR RELIEF, THEN THE ENTIRETY OF THIS ARBITRATION AGREEMENT (SECTION 15) SHALL BE DEEMED VOID AS TO THAT CLAIM OR REQUEST FOR RELIEF ONLY, AND SUCH CLAIM OR REQUEST FOR RELIEF SHALL PROCEED IN COURT.

F. Jury Trial Waiver

YOU AND GETMEDKITS WAIVE ANY CONSTITUTIONAL AND STATUTORY RIGHTS TO SUE IN COURT AND HAVE A TRIAL IN FRONT OF A JUDGE OR JURY. You and GetMedKits are instead electing to have all Disputes resolved by arbitration. In the event that the arbitration agreement is found unenforceable for any reason and a Dispute proceeds in court, YOU AND GETMEDKITS WAIVE ANY RIGHT TO A JURY TRIAL.

G. 30-Day Opt-Out Right

You have the right to opt out of this arbitration agreement and class action waiver within 30 days of the date you first use our services or agree to these Terms, whichever comes first. To opt out, you must send a written notice to [email protected] with the subject line "Arbitration Opt-Out" that includes your full legal name, the email address you provided when booking your consultation, and a clear statement that you wish to opt out of the arbitration agreement. Opt-out notices sent after the 30-day period will not be honored. If you opt out, all other provisions of these Terms remain in full force and effect. Opting out of arbitration will not affect your ability to use our services, and we will not retaliate against you in any way for exercising this right.

H. Small Claims Court Exception

Notwithstanding the foregoing, either party may bring an individual action in small claims court in the county of your residence (or, if you are a business, in Fort Bend County, Texas) for claims that are within the jurisdictional limits of the applicable small claims court. If a claim is filed in small claims court and subsequently transferred or appealed to a court of general jurisdiction, the arbitration agreement shall apply.

I. Government Enforcement Exception

Nothing in this arbitration agreement shall prevent any federal, state, or local government agency (including but not limited to the Federal Trade Commission, state attorneys general, state medical boards, and state pharmacy boards) from investigating or taking enforcement action against GetMedKits. This arbitration agreement does not apply to any action brought by a government agency in its sovereign enforcement capacity.

J. Washington MHMDA Exception

To the extent that the Washington My Health My Data Act (RCW 19.373) grants you a private right of action that cannot be waived by pre-dispute arbitration agreement as determined by a court of competent jurisdiction, such claims shall proceed in court rather than arbitration.

K. Survival

This arbitration agreement and class action waiver shall survive the termination of your relationship with GetMedKits, the completion of your services, and the termination or expiration of these Terms.

16. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless GetMedKits and its owners, officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your breach of these Terms; (b) your provision of false, misleading, or incomplete information during the intake process or at any other time; (c) your misuse of any medication prescribed through this service, including sharing, selling, or distributing medications to others; (d) your violation of any applicable law or regulation; or (e) your violation of any third party's rights.

This indemnification does not apply to claims arising from our own negligence, willful misconduct, or fraud.

This section shall survive the termination or expiration of these Terms.

17. ASSUMPTION OF RISK

You acknowledge and agree that the use of off-label and compounded medications involves inherent medical risks, including but not limited to adverse drug reactions, side effects, drug interactions, allergic reactions, and the possibility that the medications may not be effective for your condition. You voluntarily assume these risks.

You acknowledge that you are using these medications as adjunctive support and that GetMedKits has not represented that these medications will cure, treat, or prevent any disease. You acknowledge that you have been advised to continue following the treatment recommendations of your oncologist or primary care physician.

You acknowledge that the decision to prescribe was made by an independently licensed physician based on their independent clinical judgment after reviewing your individual health information, and that GetMedKits did not influence that decision.

18. CALL RECORDING CONSENT

You consent to the recording of telephone calls placed to and received from GetMedKits. Calls are recorded for quality assurance, staff training, treatment documentation, dispute resolution, and regulatory compliance purposes.

Twelve states require all-party consent before recording a telephone call: California, Connecticut, Delaware, Florida, Illinois, Maryland, Massachusetts, Montana, Nevada, New Hampshire, Pennsylvania, and Washington. If you are located in any of these states, you will hear a verbal disclosure at the beginning of your call that the call may be recorded. By continuing the call after hearing this disclosure, you consent to the recording. If you do not consent to recording, you may request that the call not be recorded or you may end the call.

Your consent to call recording under these Terms supplements, but does not replace, the verbal consent obtained at the beginning of each call.

19. SMS AND COMMUNICATION CONSENT

By providing your phone number and using our services, you consent to receive service-related text messages (SMS/MMS), phone calls, and emails from GetMedKits at the contact information you provide. These communications may include appointment reminders, prescription status updates, shipping notifications, and customer support messages.

You may opt out of text messages at any time by replying STOP to any message. Reply HELP for assistance. Message frequency varies. Message and data rates may apply.

Consent to receive text messages is not a condition of purchasing any service or product from GetMedKits. You may request alternative communication methods (phone call or email) at any time by contacting us.

Text messaging originator opt-in data and consent will not be shared with any third parties except aggregators and providers of the text messaging services.

20. TELEHEALTH CONSENT

By using our services, you acknowledge that healthcare services provided through this platform are delivered via telehealth (the use of electronic communications to provide healthcare services remotely). Our separate Telehealth Consent document, available on our website, describes the nature, risks, benefits, and limitations of telehealth services, your rights as a telehealth patient, and the circumstances under which in-person care may be recommended. You agree to review and accept the Telehealth Consent before receiving clinical services.

You acknowledge that telehealth has limitations, that not all medical conditions are appropriate for telehealth evaluation, and that the treating physician may recommend in-person evaluation when clinically indicated.

21. PRIVACY AND DATA

Your use of our services is subject to our Privacy Policy and, for Washington residents, our Consumer Health Data Privacy Policy, each of which is incorporated into these Terms by reference. By using our services, you consent to the collection, use, and disclosure of your personal information as described in those policies.

Certain health information collected through our service may constitute protected health information (PHI) governed by HIPAA. Our separate HIPAA Notice of Privacy Practices, available on our website, describes how PHI is used and disclosed and your rights under HIPAA. Where any conflict exists between these Terms and the HIPAA Notice of Privacy Practices regarding PHI, the HIPAA Notice of Privacy Practices controls.

22. FORCE MAJEURE

GetMedKits shall not be liable for any failure or delay in performing its obligations under these Terms due to causes beyond its reasonable control, including but not limited to natural disasters, pandemics, epidemics, government actions or orders, changes in law or regulation, FDA enforcement actions restricting compounded medications, active pharmaceutical ingredient shortages, pharmacy closures or recalls, telecommunications failures, internet outages, power failures, carrier or shipping disruptions, acts of war or terrorism, labor disputes, or any other event that is not reasonably foreseeable or within our control.

In the event of a force majeure event, we will make reasonable efforts to mitigate the impact, including sourcing from alternative pharmacies or suppliers where possible. If a force majeure event prevents us from fulfilling your order for more than 60 days, either party may terminate the affected transaction and we will issue a refund for any undelivered products or services.

23. TERMINATION

We may suspend or terminate your access to our services at any time, with or without cause and with or without notice, if we reasonably believe that you have violated these Terms, provided false or misleading information, engaged in fraudulent activity, or if continued service would pose a risk to your health or safety or the integrity of our platform. We may also terminate services if required by law, regulation, or government order.

You may stop using our services at any time. Termination does not relieve you of any obligations that accrued prior to termination, including payment obligations and the arbitration agreement.

Upon termination, Sections 5, 6, 10, 11, 13, 14, 15, 16, 17, 25, and 27 shall survive and remain in full force and effect.

24. NO CONTROLLED SUBSTANCES

GetMedKits and the independently licensed physicians who provide services through this platform do not prescribe controlled substances (as defined by the DEA under Schedules I through V of the Controlled Substances Act). If your medical condition requires controlled substances, you should consult with your primary care physician or specialist directly.

25. GOVERNING LAW AND VENUE

These Terms and any Dispute arising out of or relating to these Terms or our services shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions, except to the extent preempted by the Federal Arbitration Act.

This governing law provision shall not be construed to deprive any consumer of the protection of mandatory consumer protection laws of their state of residence that cannot be waived by contract.

For any Dispute not subject to arbitration (including actions to compel arbitration or enforce an arbitration award), you consent to the exclusive jurisdiction and venue of the state and federal courts located in Fort Bend County, Texas, or the Southern District of Texas.

26. SEVERABILITY

If any provision of these Terms is found by a court or arbitrator of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms. The invalidity of any provision shall not affect the validity of the remaining provisions, which shall continue in full force and effect.

Notwithstanding the foregoing, if the class action waiver in Section 15(E) is found unenforceable, the entire arbitration agreement in Section 15 shall be void as to the affected claim, as stated in Section 15(E).

27. ENTIRE AGREEMENT

These Terms, together with the Privacy Policy, Consumer Health Data Privacy Policy, Telehealth Consent, and HIPAA Notice of Privacy Practices, constitute the entire agreement between you and GetMedKits regarding your use of our services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the subject matter.

No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

GetMedKits is a telehealth coordination service. We help connect you with independently licensed physicians who review your health information and decide, based on their own medical judgment, whether to prescribe medication for you.

Here is how the process works:

You book a free informational call through our website. This call is with a patient coordinator, not a doctor. The purpose of this call is to answer your questions about how the service works, explain the process, and help you get started. This call is not a medical consultation and does not establish a doctor-patient relationship.

After the call, if you decide to proceed, you complete a medical intake form with your health history, current medications, and other relevant information.

A licensed physician independently reviews your intake and decides whether prescribing medication is appropriate for your situation. The physician may approve, modify, or decline your request based entirely on their own clinical judgment. We do not influence, direct, or control their medical decisions in any way.

If the physician approves a prescription, it is sent to a licensed U.S. compounding pharmacy, where your medication is individually prepared and shipped to you.

The physicians who review your case are independently licensed healthcare providers. They are not employees of GetMedKits. ABOUT THE MEDICATIONS

IMPORTANT RISKS AND SIDE EFFECTS

All medications carry risks. Here are some potential side effects of the medications available through this service:

Ivermectin: nausea, dizziness, rash, and in rare cases neurological effects at high doses.

Mebendazole: abdominal pain, diarrhea, and in rare cases elevated liver enzymes with prolonged use.

Methylene blue: discoloration of urine and stool (blue-green color, this is normal and harmless), nausea, and at higher doses it may interact with certain antidepressant medications including SSRIs, SNRIs, and MAOIs. This interaction can potentially cause serotonin syndrome, a serious condition that requires immediate medical attention.

It is critical that you tell your prescribing physician about ALL medications, supplements, and over-the-counter drugs you are currently taking. This includes antidepressants, anti-anxiety medications, and any other prescription drugs.
